Doctrine of Relating Back

The principle that a son adopted by a Hindu widow is treated as if the adoption had been made by her deceased husband, linking the child to the husband's line too.

Example

In Sawan Ram v. Kalawanti, a son adopted by a widow was held to be the son of her deceased husband as well, entitled to succeed to his property.

Where You'll Come Across This

Applied by courts interpreting adoptions by widows under the Hindu Adoptions and Maintenance Act, 1956, most notably in Sawan Ram v. Kalawanti and Sitabai v. Ramchandra.

Common Mix-Up: This doctrine doesn't make the adoption retroactive to before it happened — it only extends the adopted child's legal relationship to the deceased husband's branch of the family.
