Doctrine of Eclipse (గ్రహణ సిద్ధాంతం)

The rule that a pre-Constitution law inconsistent with a Fundamental Right is not void from the beginning — it merely becomes unenforceable, or "eclipsed," for as long as the inconsistency lasts, and can automatically revive if the Fundamental Right is later amended to remove that inconsistency.

ప్రాథమిక హక్కుతో విభేదించే రాజ్యాంగ-పూర్వ చట్టం మొదటి నుండే చెల్లనిది కాదు — విభేదం కొనసాగినంత కాలం అది కేవలం అమలు చేయలేనిది, "గ్రహణం పట్టినది" మారుతుంది, తర్వాత ఆ ప్రాథమిక హక్కు విభేదాన్ని తొలగించే విధంగా సవరించబడితే స్వయంచాలకంగా తిరిగి బతకవచ్చు అనే నియమం.

Real-life example

In Bhikaji Narain Dhakras v. State of Madhya Pradesh (1955), a pre-Constitution monopoly law automatically revived once the Fourth Amendment validated State trade monopolies.

Common mix-up

Applies only to pre-Constitution laws under Article 13(1) — a post-Constitution law violating a Fundamental Right under Article 13(2) is void from its very inception and cannot be revived this way.
