FACTS

Devarajiah, a member of the Jain community in Bangalore, lodged a complaint before the City Magistrate against B. Padmanna, alleging that Padmanna had issued a printed pamphlet declaring that Devarajiah had no right to worship at, or enter, any Jain temple, and calling for him to be kept out of such places of public worship belonging to the Jain community. The complaint further alleged that the pamphlet encouraged other members of the community to have no social or religious intercourse with Devarajiah — in effect, an intra-community social and religious boycott arising from a dispute within the Jain community itself.

Devarajiah invoked the Untouchability (Offences) Act, 1955, contending that this conduct amounted to enforcing "untouchability" against him within the meaning of that Act and Article 17, since he was being excluded from temple entry and ostracised socially and religiously. The proceedings before the Magistrate were brought in revision before the Mysore High Court, raising the question of whether the Act — and, by extension, the constitutional concept of "untouchability" under Article 17 — applied to this kind of religious and social exclusion of an individual arising from an intra-community dispute, as opposed to the caste-based exclusion historically practised against persons born into castes traditionally treated as "untouchable."

JUDGEMENT

The Mysore High Court held that the complaint could not be sustained under the Untouchability (Offences) Act, 1955, since the conduct alleged — an intra-community social and religious boycott unconnected with caste-based birth status — did not constitute "untouchability" within the meaning of Article 17 or the Act. The proceedings against Padmanna under the Act were accordingly not allowed to continue on this basis.

Devarajiah remains the foundational authority narrowly and precisely defining the scope of "untouchability" under Article 17, distinguishing it from any general social boycott or ostracism unrelated to caste-based birth status. This same caste-specific scope was directly relied upon decades later by the Supreme Court in State of Karnataka v. Appa Balu Ingale (1993), which confirmed the narrow definitional boundary this case drew while giving the concept a broad, purposive application within that specific scope — together, the two cases mark out both what Article 17 covers and what it deliberately does not.
