FACTS

The defendants were members of a Hindu joint family. The Karta (family manager) of the family mortgaged, sub-mortgaged, and then sold two family houses — worth roughly ₹8,000–9,000 — for a much smaller sum of only ₹400–900. He said the money was needed for the marriage of his three children, who were all minors at the time. The plaintiff, a member of the family, challenged these transactions, arguing they were not binding on him because they were not made for any real "legal necessity" — the one ground on which a Karta can validly alienate joint family property without every member's consent.

ANALYSIS
  • Under Hindu law, a Karta can only bind the other members to an alienation if it was made for legal necessity, for the benefit of the estate, or for an indispensable religious duty. The court held that arranging the marriage of a minor is none of these — it is not a legal necessity at all, because the marriage itself is something the law does not permit.

Since the debt here was raised through the impugned transactions themselves, it could not qualify as antecedent, so the sons' pious obligation to repay a father's honest antecedent debts did not apply either.

JUDGEMENT

The Rajasthan High Court held that the mortgage, sub-mortgage, and sale were not binding on the other family members. A debt incurred to marry off minor children is neither a legal necessity nor a genuine antecedent debt, since the very purpose of the debt was itself unlawful.
