FACTS

The appellants held valid permits under the Motor Vehicles Act, 1939 (a Union law) to operate stage-carriage bus services on specified routes in Uttar Pradesh, competing on those routes with buses run by the State's own road transport undertaking. In 1955, the Uttar Pradesh Legislature enacted the U.P. Transport Service (Development) Act, 1955, which empowered the State Government to develop a State-monopoly transport scheme; acting under Section 3 of this Act, the State Government issued a notification directing that certain specified routes — including those on which the appellants held permits — would thereafter be served exclusively by State-owned buses, followed by further notifications under Sections 4 and 8 giving practical effect to this exclusion. The appellants, whose existing permits and livelihood were directly displaced by this scheme, challenged the U.P. Act, arguing first that it was inconsistent with their Fundamental Right under Article 19(1)(g) to carry on their occupation and, since it was enacted after the Constitution came into force, was void from inception under Article 13(2) rather than merely "eclipsed". JUDGEMENT

The Supreme Court held that the doctrine of eclipse does not apply to post-Constitution laws: a law enacted after the Constitution's commencement that infringes a Fundamental Right is void from the moment of its enactment under Article 13(2), and cannot later be revived by a constitutional amendment removing the inconsistency, unlike a pre-Constitution law under Article 13(1), which is merely dormant and can revive automatically. On the repugnancy question, the Court held that the U.P. Transport Service (Development) Act, 1955 did not become wholly and permanently void upon enactment of the Motor Vehicles (Amendment) Act, 1956, but that any genuinely repugnant provisions would be void to that extent, while transport schemes already validly framed under the State Act before the Central Act's relevant provisions took effect remained protected.
