FACTS

The D.A.V. (Dayanand Anglo-Vedic) Colleges in Punjab were established decades earlier by followers of the Arya Samaj, a reformist Hindu religious and cultural movement founded by Swami Dayananda Saraswati, with the specific object of promoting Vedic learning and the Hindi language and Devanagari script, which the movement regarded as integral to its religious and cultural identity. These colleges had, over time, become affiliated to various universities in Punjab, including Punjabi University, established specifically to promote the Punjabi language (in the Gurmukhi script) and associated with the Sikh community's linguistic and cultural interests. Following its establishment, Punjabi University, exercising its statutory powers over affiliated colleges, sought to prescribe Punjabi as the exclusive medium of instruction and examination for all colleges affiliated to it, without providing any option for institutions like the D.A.V. Colleges to continue functioning in Hindi, the language central to their own founding purpose. The D.A.V. Colleges, whose entire institutional identity and historical mission were built around preserving and teaching in Hindi, challenged this requirement as an unconstitutional interference with their right under Article 29(1) to conserve their distinct language and culture, and under Article 30(1) to administer their own educational institutions in the manner of their choosing, including the choice of medium of instruction.
