This case held that the general principle of res judicata applies to a petition under Article 32 where an identical Fundamental Rights question, on the same facts, has already been heard and decided on the merits by a High Court under Article 226, so that the guaranteed right to move the Supreme Court does not entitle a litigant to relitigate a conclusively settled claim.

FACTS
Six connected petitions were filed under Article 32 before the Supreme Court by tenants and occupants of certain agricultural land in western Uttar Pradesh, who had lost possession of the land amid the communal disturbances and mass displacement that followed Partition in 1947. Each of these petitioners had, some years earlier, already filed a writ petition under Article 226 before the Allahabad High Court, raising substantially the same claim to the same land on substantially the same grounds; in each case, the High Court had heard the matter and dismissed the petition after examining its merits. Rather than pursuing an appeal against those High Court decisions through the ordinary appellate hierarchy, the petitioners instead filed fresh petitions directly before the Supreme Court under Article 32, seeking enforcement of what they contended were their Fundamental Rights to the same property, on essentially the same facts already adjudicated. The State raised a preliminary objection in each petition, contending that since the identical claim had already been heard and rejected on the merits by a competent court, the doctrine of res judicata (embodied in the general principle underlying Section 11 of the Code of Civil Procedure) barred the petitioners from re-agitating the same question before the Supreme Court.
ISSUES
- Whether the general principle of res judicata can apply at all to a petition filed under Article 32, given that Article 32(1) itself guarantees the right to move the Supreme Court for enforcement of Fundamental Rights.
- If res judicata can apply, what conditions must be satisfied — specifically, whether the earlier decision must have been on the actual merits of the claim, as opposed to a dismissal on a technical or preliminary ground.
- Whether applying res judicata to bar a fresh Article 32 petition would itself amount to an unconstitutional whittling-down of the guarantee in Article 32(1), which uses unqualified language ("is guaranteed").
- What remedy, if any, remains available to a litigant whose Article 226 petition was genuinely and finally decided against them on the merits, other than a fresh Article 32 petition on the same facts.
ANALYSIS
- On whether res judicata applies to Article 32 at all, the Court reasoned that the guarantee in Article 32(1) is a guarantee of the right to move the Supreme Court and have one's claim properly heard and adjudicated — it is not a guarantee of an unlimited number of opportunities to obtain a favourable outcome on an identical claim; once a competent court has genuinely heard and finally decided the very same question on its merits, the constitutional right to "move" the court in respect of that claim has already been fully exercised and satisfied, and applying res judicata thereafter does not deny access to justice but simply respects the finality of a decision already properly reached.
- On the merits requirement, the Court held that res judicata is attracted only where the earlier proceeding genuinely examined and pronounced upon the substance of the claim; a petition dismissed purely on a preliminary or technical ground — such as improper parties, lack of jurisdiction, or a procedural defect — without the court ever actually considering the underlying Fundamental Rights question, would not create any bar, since in such a case the claim was never truly adjudicated on its merits in the first place.
- On whether this dilutes Article 32's guarantee, the Court reasoned that a rule preventing endless relitigation of the same, already-decided question serves the equally important constitutional value of finality in judicial proceedings, and does not conflict with Article 32(1) since that provision was never intended to convert the Supreme Court into a forum for indefinitely repeated attempts at the same claim; treating the guarantee as unlimited in this sense would undermine, rather than serve, the orderly administration of justice.
- On the litigant's remaining remedy, the Court noted that a party genuinely aggrieved by a High Court's decision on the merits under Article 226 is not left without recourse — the proper course is to pursue an appeal against that decision through the ordinary appellate hierarchy (ultimately to the Supreme Court by way of appeal, rather than by a fresh original petition), which allows the same claim to be tested again without the finality problems created by treating Article 32 as an alternative, parallel track to relitigate an already-decided matter.
JUDGEMENT
The Supreme Court held that where a petitioner's writ petition raising a Fundamental Rights question on given facts has already been heard and finally decided on the merits by a High Court under Article 226, the general principle of res judicata applies, and the petitioner cannot maintain a fresh writ petition on the same facts and the same question under Article 32 before the Supreme Court. It clarified that this bar operates only where the earlier decision was genuinely on the merits, and does not apply where a prior petition was dismissed on a technical or preliminary ground without examination of the substance of the claim. Applying this principle to the facts, the Court held that since each petitioner's earlier Article 226 petition had been heard and dismissed on the merits by the Allahabad High Court, the fresh Article 32 petitions before it were barred by res judicata.
CONCLUSION
Daryao v. State of Uttar Pradesh remains the definitive authority establishing that Article 32, though itself a Fundamental Right, does not operate as a licence for unlimited relitigation of an already-decided claim, and its merits-versus-technicality distinction continues to be the standard test applied whenever a subsequent Article 32 petition is met with a res judicata objection based on an earlier Article 226 proceeding. The judgment strikes a careful balance between two genuinely competing constitutional values — guaranteed access to the Supreme Court for enforcement of Fundamental Rights, and the equally important principle that litigation must eventually come to an end — and remains essential reading for understanding the practical relationship between Articles 32 and 226 explored in the immediately preceding post of this unit.
