FACTS

Gurulingappa Savadi, a coparcener in a Mitakshara joint family, died in 2001 — before the 2005 Amendment — survived by two sons and two daughters, including Danamma (also known as Suman Surpur). One of the sons filed a suit for partition in 2002, contending that the daughters were not coparceners and were not entitled to a share equal to the sons, since their father had died and the family arrangement predated the 2005 Amendment. The matter proceeded through the courts, with only preliminary proceedings completed, no final decree of partition having been passed, when the daughters pressed their claim to an equal share under the amended Section 6.

ISSUES

ANALYSIS

  • The Bench reasoned that a preliminary decree in a partition suit only declares the shares of the parties in principle and does not itself effect an actual, final division of the property by metes and bounds — final partition is achieved only through a final decree.

JUDGEMENT

The Supreme Court held that the daughters were entitled to an equal coparcenary share along with their brothers, notwithstanding their father's death in 2001, because the partition suit had not been finally decided — only a preliminary decree existed — when the 2005 Amendment came into force.

CONCLUSION

Danamma reached a daughter-favourable result but, by not directly engaging with or overruling Phulavati's "living coparcener" reasoning, left the law in visible tension for two more years. Vineeta Sharma v. Rakesh Sharma (2020) later resolved this conflict decisively, expressly disapproving Phulavati and placing Danamma's outcome on a cleaner, more principled footing — that the daughter's right arises by birth, independent of her father's survival to 2005.
