FACTS

A father and son constituted a Hindu Undivided Family that ran a business. On partition of the HUF, the business assets were allotted to a partnership continued by the son, while the father retained a credit balance in the firm's account. The father subsequently died intestate, and the amount standing to his credit devolved upon the son as his sole surviving Class I heir under Section 8. For wealth tax assessment purposes, the question arose whether this inherited amount formed part of the son's individual wealth, or whether it became ancestral property of a fresh joint family consisting of the son and his own children, in which they had acquired a birthright interest merely because it had passed to their father by inheritance.

ISSUES

ANALYSIS

  • The Court examined Section 8's scheme, under which the widow, daughter and other Class I heirs take simultaneously with the son, with no textual distinction drawn between them as to how the inherited property is characterised in their hands.

JUDGEMENT

The Supreme Court held that property inherited by a son from his father under Section 8 of the Hindu Succession Act, 1956 is the son's individual, separate property, and does not automatically become joint family or ancestral property merely because it was inherited from the father — the son's own children acquire no birthright coparcenary interest in it.

Saubhag Singh (2016).
