FACTS
The Shirur Mutt was a well-known Hindu monastic institution (a "mutt", headed by a Mathadhipati or spiritual superior) with substantial landed properties dedicated to its religious and charitable purposes. In the years preceding this litigation, the Madras Legislature enacted the Madras Hindu Religious and Charitable Endowments Act, 1951, a comprehensive statute intended to reform the administration of the very large number of Hindu temples and mutts in the State, many of which were, in practice, poorly managed, encumbered with debt, or subject to mismanagement by their hereditary trustees. The Act created a Hindu Religious Endowments Board with wide powers, including the power to notify a religious institution as being in need of better financial management and to appoint an "Executive Officer" to take over significant aspects of its administration, and separately required every religious institution above a certain income to pay an annual monetary "contribution" to the Board, calculated as a percentage of its income, to fund the Board's regulatory and supervisory functions across all such institutions in the State. Acting under these provisions, the Board found the Shirur Mutt to be heavily in debt and mismanaged, and sought to appoint an Executive Officer to administer its affairs and to levy the annual contribution on it. The Mathadhipati of the Mutt challenged the relevant provisions of the Act as an unconstitutional interference with the institution's religious freedom under Articles 25 and 26, and separately challenged the annual contribution as an impermissible tax for religious purposes under Article 27. The Supreme Court held that what constitutes an essential religious practice must be determined by reference to the doctrines of the religion itself, not by the State's or the Court's own independent assessment, and struck down those provisions of the Madras Hindu Religious and Charitable Endowments Act, 1951 that permitted the Board or its Executive Officer to interfere with the Mutt's genuinely religious functions and internal religious governance, as violating Article 26(b). It upheld the provisions empowering purely secular financial supervision and administration — audit of accounts and correction of financial mismanagement — as valid under Article 25(2)(a). State of Orissa.
