FACTS

Ram Narain, a partner in a business in Mailsi, Multan District (territory that became West Pakistan), obtained a cash-credit facility from Central Bank of India in December 1946 by pledging cotton bales as security. After Partition, while still in Pakistan, he allegedly sold the pledged bales in Karachi. He later migrated to India and settled in Gurgaon; in 1950, the East Punjab Government sanctioned his prosecution for theft and criminal breach of trust.
