FACTS
The plaintiff, Mr Cassidy, was admitted to a hospital run by the defendant, the Ministry of Health, for an operation on two fingers of his hand that had become stiff. The operation itself was performed competently, but during the post-operative period his whole hand was bandaged and kept in a splint for an extended period.
