FACTS

The defendants had enclosed part of the public footway on Hammersmith Bridge, put up seating within the enclosure, and were charging members of the public admission to watch a boat race from that vantage point, while leaving the carriageway of the bridge open for passage. The plaintiff, Bird, insisted on passing along the enclosed footway rather than using the open carriageway. He was prevented from doing so by a police constable stationed there, who told him that he was free to proceed across the bridge by using the carriageway instead. Bird refused to take the alternative route and instead stood at the spot for about half an hour, after which he sued the defendants for false imprisonment.

JUDGEMENT
