FACTS

Bijoe Emmanuel and his two siblings, students at a government school in Kerala, belonged to the Jehovah's Witnesses, a Christian denomination whose tenets, as they sincerely understood them, forbade participating in any act they regarded as a form of worship or veneration directed at any authority other than Jehovah God, including saluting a flag or singing a national anthem. Each morning during the school assembly, when the National Anthem, "Jana Gana Mana", was sung, the three children stood up respectfully along with the rest of the assembly but did not themselves join in the singing, remaining silent throughout. This continued without incident for a period of time until a local member of the legislative assembly raised the matter, prompting the Deputy Inspector of Schools to direct an inquiry. A departmental Commission was constituted to examine the matter; it found, after investigation, that the children were law-abiding, had not caused any disturbance during the singing of the Anthem, and had shown no positive disrespect towards it, standing silently and respectfully throughout. Notwithstanding this finding, the Head Mistress of the school, acting on instructions, expelled the three children from school with effect from 26 July 1985. Their father's representations to the education authorities having failed, a writ petition was filed before the Kerala High Court challenging the expulsion; the High Court dismissed the petition and upheld the expulsion, reasoning broadly on the importance of showing respect to the National Anthem as a symbol of the nation. The matter then came before the Supreme Court by way of appeal.

ANALYSIS

  • On disrespect, the Court held that the Prevention of Insults to National Honour Act, 1971 penalises actual disturbance of, or intentional disrespect towards, the singing of the Anthem — it does not, on its plain terms, impose a positive obligation to sing; since the departmental Commission itself had found no disturbance and no disrespect, there was no proper factual basis, even under the very statute the State relied on, for treating the children's conduct as objectionable.

  • On the sincerity test, the Court criticised the High Court's approach of examining whether the ideals or words of the National Anthem could reasonably offend anyone, and held instead that the only relevant question is whether the individual's religious belief is genuinely and conscientiously held as part of their faith — courts are not equipped, and have no business, sitting in judgment over whether a religious tenet is rational, mainstream, or theologically sound; once genuineness is established (and the Commission's findings, along with the family's consistent, long-standing practice, supported genuineness here), the belief attracts constitutional protection regardless of how unusual it may appear to others.

  • On Article 19(1)(a), the Court held that the freedom of speech and expression logically and necessarily includes a right not to speak, and specifically a right not to be compelled to utter words one does not wish to say — forcing a person to sing particular words against their will is as much a restriction on expressive freedom as forbidding them from speaking, and no law existed that could justify compelling these particular children to sing.

  • On Article 25(1), the Court held, independently of the Article 19(1)(a) finding, that compelling a person to perform an act their genuine religious belief forbids strikes directly at freedom of conscience, which protects not only the freedom to practise one's religion affirmatively but also the freedom to abstain from an act inconsistent with it — a "negative liberty" equally deserving of protection.

JUDGEMENT

The Supreme Court allowed the appeal, set aside the judgment of the Kerala High Court, and held that the expulsion of Bijoe Emmanuel and his siblings violated their Fundamental Rights under Article 19(1)(a) and Article 25(1) of the Constitution. It held that standing respectfully in silence during the National Anthem did not amount to disrespect or to any offence under the Prevention of Insults to National Honour Act, 1971, and that no provision of law compelled the children to sing. It directed that the children be readmitted to school forthwith, and clarified that the correct legal test for the genuineness of a religious objection is whether the belief is sincerely and conscientiously held, not whether a court considers it reasonable or the underlying religious tenet theologically sound.

CONCLUSION

Bijoe Emmanuel v. State of Kerala is the leading Indian authority on freedom of conscience as a "negative liberty" — the right to abstain from an act one's faith forbids — and on the sincerity test for genuineness of religious belief, a test since applied in numerous later cases involving conscientious objection in schools, workplaces, and public institutions. Its holding that freedom of speech includes the freedom not to speak has become a standard citation in Indian free-speech jurisprudence generally, well beyond the religious-freedom context in which it arose.
