Establishes the doctrine of eclipse — a pre-Constitution law inconsistent with a Fundamental Right is not dead, only dormant, and can revive if the inconsistency is later removed.

FACTS
Stage-carriage motor transport operators challenged the C.P. and Berar Motor Vehicles (Amendment) Act, 1947, which empowered the State government to create a monopoly over motor transport and exclude private operators from specified routes; a notification dated 4 February 1955 sought to exercise this power. The Act pre-dated the Constitution and was consistent with the law then in force, but appeared to conflict with the freedom to carry on trade or business under the post-1950 Article 19(1)(g).
ISSUES
- Whether a pre-Constitution law inconsistent with Article 19(1)(g) is void ab initio and permanently dead, or merely rendered inoperative for as long as the inconsistency lasts.
- Whether such a law could be revived by a subsequent constitutional amendment removing the inconsistency.
ANALYSIS
- A pre-Constitution law inconsistent with a Fundamental Right is not void ab initio — it becomes unenforceable, or "eclipsed," only for as long as the inconsistency lasts.
- The Constitution (Fourth Amendment) Act, 1955 amended Article 19(6) to expressly permit State monopolies in trade or business, removing the inconsistency.
- Once the inconsistency was removed, the law automatically revived and became fully enforceable again, without needing to be re-enacted.
JUDGEMENT
The Court unanimously held that the 1947 Act, though inconsistent with Article 19(1)(g) when the Constitution commenced, had only been eclipsed, and had automatically revived once the Fourth Amendment validated State trade monopolies; the notification creating the monopoly was upheld.
CONCLUSION
Bhikaji Narain Dhakras remains the leading authority for the doctrine of eclipse, and it applies only to pre-Constitution laws under Article 13(1) — a post-Constitution law violating a Fundamental Right under Article 13(2) is void from its very inception and cannot be revived this way.
