This case held that once conditions resembling forced labour are shown to exist, a presumption of bonded labour arises and the burden shifts to the employer or the State to disprove it, and that the State bears a continuing, affirmative constitutional duty to identify, release, and rehabilitate bonded labourers, not merely to refrain from imposing bondage itself.

FACTS
Bandhua Mukti Morcha, an organisation dedicated to the identification and release of bonded labourers, addressed a letter directly to the Supreme Court alleging that a large number of workmen employed in stone quarries and stone-crushing units in Faridabad district, Haryana, were in fact bonded labourers, compelled to work under debt-bondage arrangements with quarry lessees and contractors, and living and working in inhuman, degrading conditions — without adequate safety equipment against silicosis and other occupational hazards, without clean drinking water, and without access to medical care or educational facilities for their children. The letter did not take the form of a conventional pleading supported by detailed affidavits from each affected workman, but set out the organisation's own findings from visiting the quarries. The Supreme Court, following the approach already adopted in People's Union for Democratic Rights v. Union of India, treated the letter as a writ petition under Article 32. Because the facts alleged were sharply disputed — the State of Haryana denied that bonded labour existed in the quarries at all, attributing the conditions described to ordinary poverty and market wage levels rather than debt-bondage — the Court could not resolve the matter on affidavits alone and took the then-unusual step of appointing two Advocate Commissioners to visit the quarries, interview workmen on the spot, and report back to the Court; it also had before it an independent academic study of the same quarries prepared by Dr. Patwardhan. The Commissioners submitted their reports (one dated 28 June 1982) documenting conditions substantially consistent with the Morcha's allegations, which the State of Haryana in turn sought to challenge as inaccurate or exaggerated.

ISSUES
- Whether a letter from an organisation, not itself a bonded labourer and not supported by individual affidavits from every affected workman, could be maintained as a writ petition under Article 32, and whether the Court could depart from ordinary rules of pleading and evidence — including by appointing its own fact-finding Commissioners — to establish the truth of the allegations.
- Whether the State of Haryana's denial that bonded labour existed in the quarries could be accepted without independent verification, given the sharply conflicting versions placed before the Court.
- What test or presumption should govern the identification of a "bonded labourer" under Article 23 and the Bonded Labour System (Abolition) Act, 1976, given that formal documentary proof of a debt-bondage arrangement will rarely exist, and the worker asserting bondage is typically the weaker, less-resourced party.
- Whether Article 23, read with the Bonded Labour System (Abolition) Act, 1976 and the Directive Principles under Articles 39(e), 39(f), 41, and 42, imposes on the State only a prohibitory duty (not to itself compel forced labour) or also a positive, affirmative duty to actively identify, release, and rehabilitate bonded labourers found anywhere within its territory, including in privately-run enterprises.
- Whether payment of wages at or above the statutory minimum, by itself, is sufficient to discharge the State's constitutional obligations toward such workmen, or whether health, occupational safety, drinking water, and the education of workers' children must also be secured as part of a genuine remedy.
- What continuing supervisory role the Court and machinery appointed by it (such as vigilance committees) should play to ensure that directions for identification, release, and rehabilitation are actually implemented, given the State's demonstrated reluctance to acknowledge the problem in the first place.
ANALYSIS
- On maintainability and procedure, the Court held that in matters concerning the fundamental rights of the poorest and most powerless sections of society, rigid adherence to the ordinary adversarial procedure of pleadings and cross-examined oral evidence would itself defeat access to justice; appointing independent Advocate Commissioners to visit the site, interview the workers directly, and report back was a legitimate and necessary judicial tool for ascertaining the truth where the affected persons could not realistically be expected to prove their case through conventional litigation.
- On the factual dispute, the Court held that a bare denial by the State, unsupported by any independent site inspection of its own, could not be preferred over the detailed, on-the-ground findings of the Court-appointed Commissioners and the independent academic study, especially where the State itself had regulatory authority over the quarries and had failed to exercise it effectively; the burden lay on the State to show that its own regulatory machinery had actually functioned, not merely to assert that no problem existed.
- On the test for bonded labour, the Court held that the moment it is shown that a workman is providing labour or service for no wages or nominal wages, or under conditions indicating an inability to leave the employment freely (such as continuing indebtedness to the employer with no realistic prospect of repayment), a presumption arises that he is a bonded labourer within the meaning of the 1976 Act, and it then falls on the employer or the State Government — the party actually in a position to know and produce the relevant records — to rebut that presumption, rather than requiring the vulnerable workman to affirmatively prove the precise terms of his own bondage.
- On the nature of the State's duty, the Court held that Article 23, read purposively with the Directive Principles specifically directed at protecting workers from economic exploitation and ensuring humane conditions of work, casts a continuing, affirmative obligation on the State to proactively search out, identify, and free bonded labourers, and to rehabilitate them thereafter — a purely reactive posture, waiting for a formal complaint from an individual bonded labourer who by definition lacks the freedom and means to complain, would render the constitutional guarantee illusory in practice.
- On the adequacy of remedy, the Court held that payment of the minimum wage alone does not exhaust the State's obligations toward workers rescued from bonded-labour-like conditions; genuine rehabilitation requires attention to occupational health and safety (particularly against silicosis in stone-quarrying work), the provision of clean drinking water and sanitation at worksites, and access to education for workers' children, since a worker released from bondage but left without a genuine alternative livelihood or basic welfare support remains highly vulnerable to falling back into the same exploitative arrangement.
- On continuing supervision, the Court held that given the State's own demonstrated reluctance to acknowledge the existence of bonded labour in the first instance, a one-time set of directions without any follow-up mechanism was unlikely to secure real compliance; the Court therefore contemplated an ongoing supervisory role, including vigilance committees and periodic reporting, to ensure that identification, release, and rehabilitation actually occurred on the ground rather than remaining on paper.
JUDGEMENT
The Supreme Court held the writ petition maintainable and accepted the substance of the findings of its own Advocate Commissioners and the independent study over the State of Haryana's bare denial. It held that workmen shown to be working without proper wages or under forced conditions in the Faridabad stone quarries were entitled to the presumption of being bonded labourers under the Bonded Labour System (Abolition) Act, 1976, unless the employer or the State proved otherwise, and that this presumption had not been displaced on the record before it. The Court directed the Union of India and the State of Haryana to identify all bonded labourers working in the quarries, to secure their immediate release, and to rehabilitate them through concrete measures including alternative employment or livelihood support, health care (with particular attention to silicosis and other occupational diseases endemic to stone-quarrying), the provision of drinking water and sanitation facilities at the worksites, and access to education for the children of the released workers. It further directed the setting up of vigilance and monitoring mechanisms to ensure genuine, sustained compliance, rather than a one-time paper exercise, and retained the matter before it for continued supervision, reflecting the Court's view that Article 23's guarantee against bonded labour would remain hollow without active, ongoing enforcement machinery.

CONCLUSION
Bandhua Mukti Morcha v. Union of India stands, alongside People's Union for Democratic Rights, as one of the two foundational judgments that shaped Public Interest Litigation in India, and remains the leading authority on bonded labour under Article 23 and the Bonded Labour System (Abolition) Act, 1976. Its presumption-shifting approach to identifying bonded labourers continues to guide courts and labour authorities when confronted with debt-bondage claims that are, by their nature, difficult for the victim to prove through conventional documentary evidence. The judgment's recognition of the State's continuing, affirmative obligation to seek out and rehabilitate bonded labourers — not merely to refrain from imposing bondage itself — has shaped subsequent bonded-labour litigation across the country, and the Court's willingness to appoint its own fact-finding Commissioners became a template later used in numerous other Public Interest Litigation matters involving vulnerable groups unable to gather evidence through ordinary means. The case also had a real, if imperfect, afterlife: continued non-compliance by the Haryana government led to further proceedings before the Supreme Court years later, underscoring the judgment's own insight that directions alone, without sustained supervisory follow-through, risk remaining unenforced on the ground.
