FACTS
The plaintiff and his wife were travelling together as passengers on the outside, upper seating of the defendant's stagecoach when it overturned as a result of the defendant's negligent driving. The plaintiff's wife was severely injured in the accident and, despite receiving medical attention, died approximately one month later from her injuries.
