FACTS

The plaintiff, a chimney sweep's boy, found a jewel — a ring set with precious stones — while sweeping a chimney. He took the ring to the shop of a goldsmith, the defendant Delamirie, so that the apprentice there could examine it, find out what it was, and have it valued. The apprentice, under the pretence of weighing the stones to assess their worth, took the stones out of their socket and, having done so, offered the boy a small sum of money for them, which the boy refused to accept. The apprentice then returned to the boy only the empty socket, without the stones. The boy sued the master goldsmith, Delamirie, in an action of trover, seeking the value of the jewel he had lost.

  • Because the defendant's apprentice removed the stones and the defendant refused to produce the jewel at trial, the Court held that this refusal should be construed against the defendant, and, in the absence of evidence to the contrary, the jury should presume that the stones were of the finest quality that would fit the socket, and assess damages on that presumption — an early and influential illustration of drawing an adverse inference against a party who withholds evidence within his own control.

JUDGEMENT

Pratt C.J. gave judgment for the plaintiff, holding the defendant goldsmith liable in trover for the value of the jewel taken by his apprentice. The Court directed the jury to assess damages on the presumption, arising from the defendant's failure to produce the jewel, that the stones were of the finest quality that would fit the socket, and the plaintiff recovered the value assessed accordingly.
