FACTS

M/s Surana Oils and Derivatives (India) Ltd. sought to establish a factory for manufacturing castor oil derivatives at a site situated within a 10-kilometre radius of the Himayat Sagar and Osman Sagar Lakes ("the twin lakes"), the principal source of drinking water for the city of Hyderabad. A Government Order had already prohibited the location of certain polluting industries within this 10-kilometre zone precisely to protect these drinking-water reservoirs. The Andhra Pradesh Pollution Control Board (APPCB) refused to grant the company Consent to Establish under the Water (Prevention and Control of Pollution) Act, 1974, citing the environmental hazard the industry posed to the twin lakes and its location within the prohibited zone. The company appealed to the Appellate Authority constituted under Section 28 of the Water Act, which reversed the APPCB's refusal and directed that consent be granted, apparently relying on a Government exemption purportedly permitted for the specific site. The APPCB then filed a Special Leave Petition before the Supreme Court under Article 136, challenging the Appellate Authority's order. A central concern raised before the Supreme Court was that the Appellate Authority, though empowered to overturn a specialised technical regulator's (the APPCB's) scientific assessment, was itself composed without any member possessing environmental science, public health, or related technical expertise — raising the question of whether such a body was institutionally competent to second-guess the Board's risk assessment at all.

ANALYSIS

JUDGEMENT

The Supreme Court set aside the order of the Appellate Authority granting consent to the company, holding that the precautionary principle placed the burden on the industry to prove the absence of environmental risk to the twin lakes, a burden it had not discharged. The Court remanded the matter, directing that the appeal be reconsidered by an Appellate Authority reconstituted to include a member with the necessary scientific/technical expertise, so that the highly technical question of environmental risk to Hyderabad's drinking water source could be properly and competently evaluated. The Court restored, pending fresh consideration, the position that the industry could not proceed with the disputed consent.

Equally significant was the Court's institutional critique: recognising that a purely legal appellate body cannot competently supervise a technical regulator's scientific findings was an early diagnosis of exactly the structural gap the NGT Act, 2010 was designed to close a decade later, by building environmental and scientific expertise directly into the tribunal's bench composition rather than leaving it to generalist appellate bodies. The case is frequently cited alongside Vellore Citizens Welfare Forum as the twin foundations of the precautionary principle in Indian law — Vellore for the principle itself, Nayudu for its consequence on the burden of proof and on adjudicatory institutional design.
