FACTS

A.K. Gopalan, a Communist leader, was detained under the Preventive Detention Act, 1950. Section 14 of the Act barred him from disclosing the grounds of his detention even to a court, and barred courts from examining those grounds. He challenged his detention as violating Articles 14, 19, 21, and 22.

ANALYSIS

  • The majority read Articles 14, 19, and 21 as mutually exclusive, watertight compartments — a law affecting personal liberty needed only to satisfy Article 21, regardless of Articles 14 or 19.

JUDGEMENT

By a majority of 5:1, the Court struck down only Section 14 of the Preventive Detention Act as unconstitutional, upheld the rest of the Act as severable and valid, and consequently upheld Gopalan's detention.

CONCLUSION

Gopalan gave Indian law both the doctrine of severability and a restrictive reading of personal liberty that stood for nearly three decades — the latter was decisively overturned by Maneka Gandhi v. Union of India (1978), which read Articles 14, 19, and 21 together for the first time.
