"Void ab initio" is Latin for "void from the beginning" — it describes an agreement that was never legally binding at any point, not even for a moment. This is different from a contract that starts out valid and only becomes void later, or one that's merely voidable at someone's option. Once something is void ab initio, there's nothing to rescind and nothing to enforce, because in law it never existed as a contract at all.
A 15-year-old signs a loan agreement with a lender. Years later, after turning 18, he wants to challenge it. He doesn't need to prove fraud, unfairness, or anything else about how the loan was made — his minority alone means the agreement was void ab initio, as settled by Mohori Bibee v. Dharmodas Ghose, so there was simply never a valid contract to enforce in the first place.
Void ab initio is the exact phrase examiners look for when a minor's agreement question is answered — and it's the term that separates a strong answer from a merely adequate one that just says "void" without capturing the "from the very start" nuance.
Students often use "void" and "void ab initio" as if they always mean the same timing. They don't — a contract can become void later too (Section 2(j)), after being perfectly valid at formation. "Void ab initio" specifically means the defect existed from day one, as with a minor's agreement, not a later-arising one.
