Undue Influence — అండ్యూ ఇన్‌ఫ్లుయెన్స్

Undue influence is what happens when someone in a position of trust or authority over another person uses that position to get an unfair advantage in a contract — no threats, no lies, just the quiet leverage of an existing relationship. Doctors over patients, guardians over wards, and religious advisors over devotees are the classic examples.

REAL-LIFE EXAMPLE

An elderly, seriously ill patient is entirely dependent on his doctor for care. During treatment, at a moment when the patient is weak and anxious, the doctor persuades him to gift over a valuable property. Because the doctor held a position of dominance due to the patient's distress, the burden falls on the doctor to prove he didn't misuse that position — not on the patient to prove that he did.

COMMON MIX-UP

Students often think any unequal bargaining power — like a big company dealing with a small vendor — counts as undue influence. It doesn't. Section 16 needs an actual relationship of dominance recognised by law (authority, fiduciary duty, or the other party's genuine mental/bodily distress), not just one side having more money or leverage.
