The plaintiff constructed 16 shops on old foundations without the notice and sanction required under the U.P. Municipalities Act. The Town Area Committee, acting through its Chairman and Vice-Chairman, issued a notice under Section 186 of the Act and demolished the constructions when the plaintiff failed to comply within the time given. The Allahabad High Court held that since the plaintiff's own construction was unauthorised and the demolition was carried out under lawful statutory power, no legal right of the plaintiff had been infringed. The presence or absence of malice on the part of the officials was irrelevant, and mere malice cannot entitle a person to compensation for an otherwise lawful act.
