Surjit Lal Chhabda owned a property called Kathoke Lodge as his self-acquired, separate property, along with income from partnership firms and bank interest. In 1956, he made a sworn declaration that he was throwing Kathoke Lodge into the family "hotchpot," intending to hold it as karta of a joint Hindu family consisting of himself, his wife, and his unmarried daughter — he had no son. He then sought to have the rental income assessed as the income of the joint family rather than his individual income.
