Facts

The husband and wife jointly filed a petition for divorce by mutual consent under Section 13-B. Before the second motion could be moved, the wife withdrew her consent. The husband nonetheless pressed for the decree to be passed, arguing that once the first motion was filed with genuine consent, the decree had to follow after the statutory waiting period regardless of any later change of mind.

Judgement
