FACTS

D.R. Gupta had five sons, all of whom eventually died, leaving their families as members of the HUF "D.R. Gupta & Sons." The son of one of the younger brothers claimed the position of Karta as the senior-most surviving male member. Sujata Sharma, the eldest daughter of the eldest son, challenged this, arguing that as the senior-most coparcener in the family — following the 2005 amendment recognising daughters as coparceners by birth — she was entitled to be Karta.

ISSUES

i. Does Section 6 of the Hindu Succession Act, as amended in 2005, extend to the right to become Karta, or only to inheritance rights?
ii. Can the senior-most female coparcener become Karta of an HUF?

ANALYSIS
  • The defendant argued that Section 6 gave daughters equal coparcenary rights only for inheritance purposes, not the right to manage HUF property as Karta.
  • The Court held that Section 6 extends the full incidents of coparcenary status to daughters, and nothing in the provision limits this to inheritance while excluding management.
  • Since seniority — not gender — has always been the basis for who becomes Karta, and daughters are now coparceners on the same footing as sons, the senior-most coparcener is entitled to be Karta regardless of sex.
JUDGEMENT

The Court declared Sujata Sharma entitled to be recognised as Karta of the HUF, being its eldest living coparcener. This was affirmed by a Division Bench of the Delhi High Court on appeal.

CONCLUSION

This case is the key modern authority confirming that the 2005 amendment's grant of full coparcenary status to daughters carries with it the right to become Karta, ending the traditionally male-only character of that position.
