B.K. Mondal & Sons, a contractor, constructed certain godowns for the State of West Bengal at the request of a government officer, in the expectation that a formal contract, executed as constitutionally required, would follow. No such valid contract was ever actually executed. The State nonetheless took possession of the completed godowns and used them, but disputed liability to pay, arguing that in the absence of a properly executed government contract, there was no binding obligation.
