South Staffordshire Water Co. v. Sharman (1896)

An employee cleaning his employer's pool found gold rings buried in the mud — and lost them to the landowner, because objects attached to land belong to whoever has the superior right to the land.

FACTS

Sharman, an employee of South Staffordshire Water Co., was directed by his employer to clean out a pool of water on the company's own land. While doing so, he found two gold rings embedded in the mud at the bottom of the pool. He refused to hand the rings over to his employer, claiming a finder's right to keep them, and the company sued to recover them.

ISSUES
  1. Whether an employee who finds an object embedded in his employer's land, while acting in the course of his employment, is entitled to keep it as finder.
  2. Whether a landowner's rights over their own land extend to objects embedded in or attached to it, even without prior knowledge of their existence.
ANALYSIS
  • The court held that a person who owns or occupies land generally possesses everything embedded in or attached to that land, even without specific knowledge of its existence.
  • This was distinguished from Bridges v. Hawkesworth, where the object was merely lying loose on the surface of a publicly accessible area, not embedded in the land itself.
    Bridges v. Hawkesworth
  • Since the rings were embedded in the mud at the bottom of a pool on the company's own land, the company's pre-existing right over the land extended to them.
JUDGEMENT

The court held for the water company, ordering Sharman to hand over the rings to his employer.

CONCLUSION

This case supplies the contrasting principle to Bridges v. Hawkesworth: whether an object is loose on the surface, or embedded in or attached to land, decides whether the finder or the landowner holds the superior right to it.
