Facts

Services were rendered to a minor at his own request, and — importantly — those same services continued to be provided, still at his request, after he reached the age of majority. Once an adult, he promised to pay for the services rendered to him. When payment was later disputed, the question was whether the services provided before he turned major (technically "past" by the time the promise to pay was made) could count as valid consideration for that promise.

Analysis

• The court applied Section 2(d)'s wording directly: consideration includes something the promisee "has done or abstained from doing" at the promisor's desire — this covers acts already completed before the promise, not just future acts, unlike the stricter English position which generally rejects past consideration.

• The critical fact was that the services were rendered at the promisor's own request throughout — both before and after he became a major. This continuous request is what turned what could otherwise look like a mere voluntary act into something done specifically at his desire.

• The court held that the minor's status at the time services began did not defeat the claim, since the relevant promise to pay was made only after he reached majority and had full capacity to contract — the minority issue attached to the earlier request, not to the binding promise itself.

• This case is often read alongside Durga Prasad v. Baldeo: both turn on whose desire prompted the act, but here the promisor himself made the request, while in Durga Prasad it was a third party (the Collector) who did.
