Savitri Pandey v. Prem Chandra Pandey (2002)

A marriage that never really worked out is not, by itself, proof of cruelty or desertion — the Supreme Court insisted on real evidence, not just an unhappy outcome.

Facts

The wife filed a petition for divorce against her husband, alleging cruelty and desertion. The marriage had never been consummated, and there were mutual, largely unsubstantiated accusations between the parties about who was responsible for its failure. Evidence also suggested the wife herself had left the matrimonial home without clearly justified cause.

Issues
  1. Can vague or general allegations, without cogent evidence of specific acts, establish cruelty or desertion for the purposes of divorce?

  2. Can a petitioner who has themselves left the matrimonial home without sufficient cause still succeed in a claim based on the other spouse's alleged desertion?

Analysis
  • The Supreme Court reiterated the settled principle that a party cannot take advantage of their own wrong — a petitioner who has themselves caused or contributed to the separation cannot then successfully claim that the other spouse deserted them.

  • The Court held that the mere fact a marriage has failed, or was never consummated, is not by itself sufficient proof of cruelty or desertion — specific, cogent evidence of the respondent's conduct is required.

  • The Court also emphasised that intention (animus deserendi) is essential for desertion, and cannot be inferred merely from the fact of physical separation between the parties.

Judgement

The Supreme Court dismissed the wife's petition for divorce, holding that neither cruelty nor desertion had been proved against the husband with the required specificity, and that the wife herself had left the matrimonial home without sufficient justification.

Conclusion

Savitri Pandey stands for the proposition that an unhappy or unconsummated marriage is not, on its own, a ground for divorce — the specific statutory ground pleaded must be proved with real evidence, and a petitioner's own conduct is always relevant to that proof.
