FACTS

Meena Mathur married Jitender Mathur under Hindu law and had three children. Without obtaining a divorce from Meena under the Hindu Marriage Act, Jitender converted to Islam and went through a second marriage with another woman. The petition was clubbed with similar cases of other women whose Hindu husbands had also converted to Islam solely to solemnise a second marriage while their first Hindu marriage still legally subsisted.

ANALYSIS

  • Conversion to Islam does not, by itself, automatically dissolve a marriage solemnised under the Hindu Marriage Act — the marriage subsists until dissolved through the proper legal process under that Act.

Conversion to Islam does not dissolve the earlier Hindu marriage.

Sarla Mudgal remains the leading authority confirming that the monogamy condition under Section 5(i) cannot be circumvented through religious conversion, and it is routinely cited alongside Yamunabai Anantrao Adhav for the principle that a bigamous second marriage is void from the outset.
