FACTS

The respondent, a forward-contract dealer, paid sales tax to the department on certain transactions, genuinely believing the tax was validly payable under the applicable state sales tax law. The provision under which the tax had been levied on such transactions was subsequently held ultra vires by the courts. The respondent then sought a refund of the tax already paid, on the ground that he had paid it under a mistake, since the law never actually authorized the levy.
