Rita Nijhawan v. Balkishan Nijhawan (1973)

"Impotence" for annulling a marriage is not limited to total physical incapacity — an inability to have reasonably satisfactory sexual intercourse is enough.

FACTS

The wife sought a decree of nullity of her marriage on the ground that it had never been consummated owing to the impotence of the husband under Section 12(1)(a) of the Hindu Marriage Act. The evidence suggested that the husband was not entirely incapable of sexual intercourse in a strict physical sense, but was unable to achieve a reasonably satisfactory conjugal relationship, at least in part due to psychological factors.

ISSUES

  1. What does "impotence" mean for the purposes of Section 12(1)(a) of the Hindu Marriage Act?
  2. Does it require total physical incapacity for intercourse, or does a lesser degree of incapacity also qualify?

ANALYSIS

  • The Court held that "impotence" should not be read narrowly to mean only a complete, absolute inability to have any sexual intercourse whatsoever.
  • An incapacity to have reasonably satisfactory sexual intercourse — including incapacity caused by psychological or emotional factors, not just purely physical ones — is sufficient to establish impotence under this provision.
  • This broader reading protects a spouse from being locked into a marriage that cannot deliver a genuine conjugal relationship, even where the incapacity is not purely anatomical.

JUDGEMENT

The Delhi High Court held that impotence under Section 12(1)(a) extends to an incapacity for reasonably satisfactory sexual intercourse, including incapacity of a psychological nature, and granted a decree of nullity on this ground.

CONCLUSION

Rita Nijhawan remains the standard authority for a broad, functional understanding of impotence under Section 12(1)(a), extending relief to genuine cases of incapacity that fall short of complete physical inability.
