FACTS

To save the family estate from a threatened auction arising out of a family dispute, Raghunath Prasad borrowed money from Sarju Prasad, a moneylender, at an exceptionally high rate of compound interest. When sued for the debt years later, Raghunath argued the loan transaction had been procured by undue influence, given the moneylender's dominant position.
