FACTS

A contract was made for the sale of cotton "to arrive ex Peerless from Bombay." Unknown to both parties, there were two different ships named Peerless sailing from Bombay at different times — one in October, one in December. The buyer meant the October ship; the seller meant the December ship.

ISSUES
