Facts

The parties owned adjacent plots of land. To protect their own land from flood water flowing through a breach in the embankment of a local watercourse (vagu), the defendants dug a trench and built bunds (earthen embankments) on their own plots. As a side effect, rainwater that would otherwise have drained differently was directed onto the appellants' land, damaging their crops. The appellants sued for an injunction to remove the bunds and trench, and for damages.
