Nominal Damages —

Nominal damages are a small, token sum a court awards when a breach of contract is proved but the claimant has suffered no real, quantifiable loss. They exist to formally vindicate the claimant's legal right, not to compensate for actual harm.

REAL-LIFE EXAMPLE

A supplier delivers goods two days late, but the buyer suffers no actual loss since the goods were not needed urgently — a court may still award a token sum to acknowledge the breach occurred, even though no real damage followed.

WHERE YOU'LL COME ACROSS THIS

Examiners use nominal damages to test whether a student understands that proving a breach and proving a recoverable loss are two separate things — a valid claim does not always mean a substantial award.

COMMON MIX-UP

Nominal damages are not the same as a failed claim. The claimant still wins — the breach is legally established — but the amount awarded is small precisely because no real financial harm was proved, not because the case was weak.
