Necessaries — నెసెసరీస్

Necessaries are the one situation where the law makes an exception to a minor's blanket incapacity to contract — things genuinely needed for a person's life, judged against their actual condition and what they already have, not what a seller considers reasonable. Even then, the minor isn't personally liable; only their property is.

REAL-LIFE EXAMPLE

A 16-year-old orphan living independently buys a mattress and blanket on credit from a shopkeeper because he has none. The shopkeeper can recover the price from the minor's property, since basic bedding for someone with no other means genuinely counts as a necessary suited to his condition in life.

Necessaries shows up whenever a problem question has a minor buying something on credit — the exam is almost always testing whether you'll correctly say "his property, not him personally," and whether the goods were genuinely necessary given what he already had.

COMMON MIX-UP

Students often assume "necessaries" means anything cheap or basic. It doesn't — it's judged against what the specific minor already has and their station in life, as Nash v. Inman shows: extra clothing wasn't necessary for a minor who already had enough, even though clothing in general clearly can be.
