When a marriage has been dead in every practical sense for years, should the law still refuse to bury it just because no one committed a listed matrimonial offence? The Supreme Court said no — and asked Parliament to say so too.

The marriage had completely broken down for years with no realistic possibility of reconciliation, yet the wife refused to consent to a divorce and continued to resist the husband's petition.

The Court exercised its extraordinary discretionary power under Article 142 of the Constitution to do complete justice between the parties, since the ordinary grounds under Section 13 did not squarely cover a situation of pure, mutual, irretrievable breakdown.

The Supreme Court granted the divorce by invoking its powers under Article 142, and directed the husband to pay the wife a substantial lump sum by way of permanent alimony as a condition of the decree.
