Moses v. Macferlan (1760)

A dispute over promissory notes became the foundation of the entire modern quasi-contract doctrine, when the court allowed recovery of money simply because justice required it to be refunded.

FACTS

Moses indorsed four promissory notes to Macferlan, under an express agreement that Moses would not be held personally liable as indorser. Despite this agreement, Macferlan sued Moses on two of the notes in the Court of Conscience, a summary court whose rules did not allow the collateral agreement to be raised as a defence, and recovered judgment against him. Moses paid the sum ordered, and then sued Macferlan in the Court of King's Bench to recover back that money.

JUDGEMENT
