Misrepresentation is a false statement made honestly, without any intention to deceive — the person genuinely believed what they said was true. It still makes the contract voidable for the misled party, but it's treated more leniently than fraud precisely because there's no dishonesty behind it.
A seller tells a buyer his car gets "around 20 km per litre," genuinely believing this based on his own driving, though he never actually checked. It turns out to average only 14. Since the seller honestly believed his statement, this is misrepresentation, not fraud — the buyer can still avoid the contract, but can't claim the seller was dishonest.
Misrepresentation almost always shows up paired against fraud and mistake in a "distinguish between" essay question, and the "means of discovering the truth with ordinary diligence" proviso to Section 19 is the exam's favourite twist on it.
Students often use "misrepresentation" and "fraud" interchangeably in answers. Examiners specifically look for the intent element — state clearly whether the person believed their statement was true (misrepresentation) or knew/didn't care whether it was false (fraud), since the whole point of a distinguish question is testing that you know the difference.
