Mallesappa Bandeppa Desai v. Desai Mallappa (1961)

Explains the doctrine of blending — and holds that only a coparcener, never a female limited owner, can throw separate property into the joint family stock.

FACTS

Channamma, a widow, obtained certain properties at Jonnagiri by succession from her father, holding them as a limited owner under the pre-1956 Hindu law of women's estates. The appellants (her grandsons' line) claimed that Channamma had allowed these properties to be thrown into the common stock of her husband's family, so that they acquired the character of joint family property through blending, entitling the appellants to a share on partition.

ISSUES

i. What does the doctrine of blending actually require?
ii. Can property held by a Hindu female as a limited owner be blended into joint family property in this way?

ANALYSIS
  • The Court held that the doctrine of blending presupposes a coparcener who already has an interest in coparcenary property and who voluntarily, deliberately, and unambiguously intends to abandon his separate claim in his own property by merging it into the common stock.
  • Clear and unequivocal intention is essential — mere use of the property by the family, or its being kept along with joint family property, is not enough.
  • Since a female holding a limited estate is not a coparcener, she has no coparcenary interest to which she could add her separate property; the doctrine cannot be stretched to apply to her.
JUDGEMENT

The Court held that Channamma's limited estate could not have been blended into the joint family property, since she was never a coparcener capable of invoking the doctrine.

CONCLUSION

This case remains the leading authority defining the scope and limits of the doctrine of blending — requiring an existing coparcener with clear, provable intent, and excluding female limited owners from its application.
