A Hindu adoption is not complete merely because a ceremony was performed — the actual physical act of giving and taking the child is essential to its validity.

FACTS
Moti Singh, an old man with no son, was persuaded by his elderly relative Sujan Singh to take a boy in adoption to continue his line. A boy was claimed to have been adopted to Moti Singh in 1923, with his wife Rup Kanwar also involved in the family. Years later, a dispute arose over property in the family, and the validity of that adoption — specifically, whether the boy had actually been physically given and taken in adoption, as opposed to a ceremony being performed without that essential act — came to be examined by the courts.
ISSUES
- Is a formal ceremony of physically giving and taking the child essential for a valid Hindu adoption?
- Can the physical act of handing over or receiving the child be delegated to a third party?
ANALYSIS
- Under Hindu law, an adoption is not valid unless there has been a formal ceremony of giving and taking — this applies across castes and communities.
- No particular form is prescribed for the ceremony, but the natural parent must hand over the child, and the adoptive parent must receive him — the exact ritual can vary with circumstances.
- The parents may delegate the physical act of handing over or receiving to a third party, once they have exercised their own volition to give and take the child.
- The purpose of the physical ceremony is to secure due publicity for the adoption — a purely private, undisclosed arrangement does not satisfy this requirement.
JUDGEMENT
The Supreme Court held that the ceremony of giving and taking, essential for the validity of an adoption, had not taken place in this case, and the adoption was accordingly invalid. The Court reaffirmed that this ceremony is a mandatory requirement of a valid Hindu adoption and cannot be dispensed with merely because other formalities were observed.
CONCLUSION
Lakshman Singh Kothari is the standard authority for the proposition that intention and ceremony alone are not enough — a Hindu adoption also needs the actual physical act of giving and taking, consistent with Section 11(vi) of the Hindu Adoptions and Maintenance Act, 1956.
