Two decades after Lallu Yeshwant Singh, the Supreme Court restated the same principle in even sharper terms — settled possession is protected, even from someone who may have every right to eventually get the property back through law.

The respondent was carrying on a restaurant business from certain premises. The appellant, asserting a superior right, forcibly took over the premises and the business without following any legal process. The respondent, who had been in actual, settled possession of the restaurant business and premises, sued for restoration.
- Can a person be dispossessed of a business/property by force, even on the assumption that the person taking over may have a better underlying right?
- Does the remedy of restoration of possession extend beyond land to a running business conducted from premises?
- Where a person is in settled possession of property, he cannot be dispossessed by the owner except by recourse to law, even on the assumption that he had no right to remain there.
- This protection is not limited to land alone — it extends to a running business and the premises from which it operates.
- Reaffirming Lallu Yeshwant Singh, the Court held that forcible self-help remains impermissible regardless of the underlying merits of the parties' competing claims.
Lallu Yeshwant Singh
The Supreme Court restored possession of the restaurant business and premises to the respondent, holding that the appellant's forcible takeover, without recourse to law, could not be allowed to stand, irrespective of whatever underlying claim the appellant believed he had.
Krishna Ram Mahale confirms and extends the Lallu Yeshwant Singh principle to a modern commercial context — settled possession of a business, not just land, is a real legal interest that the courts will protect against forcible self-help, reinforcing Section 6's core purpose.
