Facts

In 1877, Nawab Khwaja Muhammad Khan executed a registered agreement promising to pay ₹500 a month, secured against specific immovable property, as "kharch-i-pandan" (a customary personal allowance) to Husaini Begum, following her marriage to his son, Rustam Ali. Both parties to the marriage were minors at the time, so Husaini Begum only formally moved into her husband's home in 1883. The couple lived together until 1893, when marital differences led her to leave and return to her own family home. Khan then stopped paying the promised allowance. Husaini Begum sued her father-in-law to recover the arrears. The trial court (Subordinate Judge) dismissed her suit, holding she had forfeited the allowance by leaving the marital home. On appeal, the Allahabad High Court reversed and ruled in her favour. Khan then appealed to the Privy Council.

Analysis
