Facts

The Howrah Town Hall Fund set out to raise money by subscription to build a town hall. Kedar Nath, a Municipal Commissioner and trustee of the fund, entered into a contract with a contractor to construct the hall, relying on the subscriptions collected. Gorie Mohammad had subscribed ₹100 towards the fund but later refused to pay, arguing his promise was a bare gratuitous promise with no consideration. The trial court sided with Gorie Mohammad, partly on the basis that he was uneducated and may not have understood what he was subscribing to. Kedar Nath appealed to the Calcutta High Court.

Analysis
