Kanwal Ram v. Himachal Pradesh Administration (1966)

Showing that a couple went through some wedding-like function is not enough for a bigamy conviction — the specific ceremonies essential under the parties' own personal law must be strictly proved.

FACTS

The accused was charged with bigamy on the allegation that he had contracted a second marriage while his first marriage was subsisting. As in Bhaurao Shankar Lokhande, the evidence on record did not clearly establish that the specific ceremonies essential to a valid marriage under the parties' personal law had actually been performed at the alleged second marriage.

ISSUES

  1. Can a bigamy conviction rest on general evidence that some marriage-like ceremony took place, without specific proof of the essential rites?
  2. What standard of proof applies to establishing that the essential ceremonies of a valid marriage were performed?

ANALYSIS

  • The Court reaffirmed the principle in Bhaurao Shankar Lokhande that a bigamy prosecution cannot succeed without strict proof that the essential ceremonies of a valid marriage were performed at the second wedding.
  • A vague or general assertion that "a marriage took place," without identifying and proving the specific essential rites, is not sufficient evidence of a valid second marriage.
  • This heightened evidentiary standard protects the accused from a bigamy conviction resting on an ambiguous or unproven ceremonial foundation.

JUDGEMENT

The Supreme Court reaffirmed that strict proof of the essential ceremonies of the second marriage is a mandatory requirement for a bigamy conviction, and in the absence of such proof, the conviction could not stand.

CONCLUSION

Kanwal Ram is consistently read together with Bhaurao Shankar Lokhande as joint authority for the rule that essential ceremonies, not mere social recognition of a union, decide whether a marriage — and therefore a bigamy charge — is valid.
