FACTS

A dispute arose in connection with a building/construction arrangement, and an arbitrator was appointed under Section 11(6) of the Arbitration and Conciliation Act, 1996 to adjudicate the matter between the contracting parties. A person who was not a signatory to the arbitration agreement sought to remain present during, or otherwise participate in, the arbitral proceedings, claiming a stake in the underlying dispute. Once the arbitrator had already been appointed, further directions were also sought from the referring court on ancillary matters connected with the arbitration.

ANALYSIS
  • Allowing a non-signatory to remain present in or observe arbitral proceedings would violate the confidentiality mandate built into the Arbitration and Conciliation Act, 1996 (Section 42A).

JUDGEMENT

The Supreme Court held that permitting a non-signatory to remain present in the arbitral proceedings was beyond the scope of Section 11(6) and violated the Act's confidentiality mandate, and further held that the referring court, having already appointed the arbitrator, had no power to issue the further ancillary directions sought.
