Joint Hindu Family —

A Joint Hindu Family (also called a Hindu Undivided Family) is the larger social and legal unit consisting of a common male ancestor, all his lineal descendants, their wives, and unmarried daughters. It is a status created by birth, not by contract — no agreement is needed to form one, and Hindu law presumes every family is joint until separation is proved.

Real-life example

A grandfather, his two sons, their wives, and their children living together — or even separately, but legally still undivided — form a joint Hindu family, regardless of whether they own any property together.

Where you'll come across this

Central to every topic in this unit — Coparcenary, Karta, Partition, and Debts all presuppose an existing joint family as the backdrop.

Common mix-up

Students often use "joint family" and "coparcenary" interchangeably. They aren't the same — a joint family includes female members and can exist without any coparcener beyond a single male member (Surjit Lal Chhabda v. CIT, 1975); a coparcenary is a narrower group within it.
