Facts

Several chemical industries — Hindustan Agro Chemicals Limited and sister concerns Silver Chemicals, Rajasthan Multi Fertilizers, Phosphate India, and Jyoti Chemicals — set up operations in and around Bichhri village, Udaipur district, Rajasthan, to manufacture chemicals including "H-acid" and oleum, without obtaining the required clearances from the Rajasthan State Pollution Control Board and without installing any effluent-treatment equipment. Highly toxic sludge and effluents were discharged directly into the surrounding environment, contaminating the soil and groundwater over a wide area. The Indian Council for Enviro-Legal Action, an environmental NGO, filed a writ petition under Article 32 on behalf of the affected villagers.

Analysis

Expert reports from the Rajasthan State Pollution Control Board and NEERI (National Environmental Engineering Research Institute) were placed before the Court, documenting extensive contamination of soil and groundwater across a wide radius around the industrial units — water that had become unfit for drinking or irrigation, and agricultural land rendered unproductive. The Court found this evidence consistent and unbiased, and rejected the industries' attempts to disclaim responsibility as "clearly an afterthought." NEERI estimated the cost of remedial measures at over Rupees forty crores. Judgement

The Supreme Court held the respondent industries liable for the entire cost of remedying the environmental damage, applying the "polluter pays" principle and the absolute liability standard (as laid down earlier in M.C. Mehta v. Union of India, the Oleum Gas Leak Case, 1987). It ordered the closure and sealing of all the plants, factories, and machinery of the responsible respondents located in Bichhri village, and directed the Rajasthan State Pollution Control Board to enforce this closure.
